1What Freeshop is — and is not

1.1. Freeshop is a platform that lets users offer items free of charge and lets other users respond to and collect those items.

1.2. Freeshop is an intermediary only. We do not own, inspect, sell, give away, deliver or guarantee any item. Every exchange is an arrangement directly between the user offering the item ("Giver") and the user receiving it ("Receiver"). Freeshop is not a party to that arrangement.

1.3. The Service is currently provided free of charge. No payment is made through the app, and no item listed may be sold, bartered or exchanged for money or anything of value.

2Eligibility

2.1. You must be at least 18 years old and capable of entering a binding contract. By using the Service you confirm this.

2.2. We may suspend or close any account we reasonably believe belongs to a person under 18, and will delete that person's data in line with our Privacy Policy.

3Accounts

3.1. You may register one account, with accurate information. You are responsible for keeping your login credentials secure and for all activity under your account.

3.2. You must not impersonate anyone, use another person's account, or create an account after we have banned you.

4Listings and exchanges

4.1. A listing must describe the item truthfully, including its condition and any known defects or safety issues. Items are offered "as is".

4.2. The Giver confirms they lawfully own the item and have the right to give it away.

4.3. When a Receiver's response is confirmed, the Giver and Receiver arrange hand-over between themselves. Freeshop provides no delivery, escrow or guarantee.

4.4. Prohibited items. You must not list, request or hand over:

• food, drink or any consumable product (including supplements, baby formula and pet food);
• alcohol, tobacco, vapes or related products;
• medicines, prescription drugs, controlled or illegal drugs, or drug paraphernalia;
• weapons of any kind, including firearms, knives (other than ordinary domestic cutlery sets, which we may still remove at our discretion), ammunition, explosives and fireworks;
• stolen, counterfeit or otherwise unlawful goods;
• recalled products or items known to be unsafe (e.g. non-compliant electrical goods, furniture without required fire-safety labels, car seats or helmets with unknown accident history);
• live animals or animal parts covered by wildlife protection laws;
• pornographic, sexually explicit or adult-only materials;
• personal data, accounts, documents, IDs or financial instruments;
• anything whose possession, supply or transfer is restricted or illegal in the UK.

We may update this list at any time and may remove any listing at our discretion.

5User content and licence

5.1. You retain ownership of content you post (text, photos). You grant Freeshop a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute that content within the Service for the purpose of operating and promoting the Service.

5.2. You confirm you have the rights to all content you post and that it does not infringe anyone's rights or any law.

5.3. We do not pre-approve listings and are not responsible for user content, but we may remove or edit content that breaches these Terms, the User Agreement or the law.

6Karma and reputation

The Service displays a "karma" score reflecting your activity and completed exchanges. Karma is an automated, indicative trust signal only; it is not a guarantee of any user's reliability. We may adjust or reset karma to correct errors or abuse.

7Reporting, moderation and enforcement

7.1. Every listing and profile includes a Report function. We review reports and act on confirmed breaches, normally within 48 hours.

7.2. We may remove content, restrict features, suspend or terminate accounts where we reasonably believe these Terms, the User Agreement or the law have been breached, or where necessary to protect users or comply with our legal obligations (including the Online Safety Act 2023). We will act expeditiously to remove illegal content once we become aware of it, and may report serious illegal activity to the authorities.

7.3. If your content is removed or your account is restricted, you may appeal by emailing freeshopappuk@gmail.com or contacting us in the app.

8Availability and changes to the Service

The Service is provided "as is" and "as available". We may modify, suspend or discontinue any part of the Service. We will give reasonable notice of material changes where practicable.

9Disclaimers

9.1. To the extent permitted by law, we make no warranty about the quality, safety, legality or fitness for purpose of any item listed, the accuracy of any listing or karma score, or the conduct of any user.

9.2. You exchange items and meet other users at your own risk. Please take sensible precautions (meet in public places, check items before accepting them, do not accept unsafe goods).

10Limitation of liability

10.1. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under English law.

10.2. Subject to 10.1, we are not liable for: loss or damage arising from items obtained or given away via the Service; the acts or omissions of any user; loss of data, goodwill or opportunity; or any indirect or consequential loss.

10.3. Subject to 10.1, our total liability to you in connection with the Service is limited to £100 (the Service being free of charge).

10.4. Nothing in these Terms affects your statutory rights as a consumer.

11Indemnity

You agree to compensate Freeshop for losses, claims and reasonable costs arising from your breach of these Terms or the User Agreement, your content, or your misuse of the Service, except to the extent caused by our own fault.

12Termination by you

You may stop using the Service and delete your account at any time in the app settings. Sections 5, 9, 10, 11 and 14 survive termination.

13Changes to these Terms

We may amend these Terms. We will notify you in the app or by email at least [14 days] before material changes take effect. If you continue using the Service after that date, the new Terms apply; if you do not agree, you must stop using the Service and may delete your account.

14Governing law and disputes

These Terms are governed by the laws of England and Wales. Disputes are subject to the jurisdiction of the courts of England and Wales; if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. Disputes between users about items or exchanges are for the users concerned to resolve; Freeshop is not a party to them but may assist with information where legally appropriate.

15Miscellaneous

If any provision of these Terms is found invalid, the rest remain in force. These Terms are personal to you and may not be transferred. Our failure to enforce a provision is not a waiver.
